Happy Mary Studio – Maria Thaens

1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen, die über den Online-Shop happymarystudio.de aufgegeben werden. Vertragspartner ist Maria Thaens, Happy Mary Studio (nachfolgend „Happy Mary Studio").

2. Vertragsschluss
Mit dem Absenden einer Bestellung geben Sie ein verbindliches Angebot zum Kauf ab. Der Kaufvertrag kommt zustande, sobald wir Ihre Bestellung per E-Mail bestätigen.

3. Preise & Steuern
Alle Preise sind in Euro angegeben und verstehen sich inklusive der gesetzlichen Mehrwertsteuer. Die jeweils gültige Mehrwertsteuer richtet sich nach dem Lieferland innerhalb der EU.

4. Zahlung
Die Zahlung erfolgt über die im Shop angebotenen Zahlungsmethoden (PayPal sowie alle von Shopify Payments angebotenen Zahlungsmethoden). Die Zahlung ist sofort bei Bestellabschluss fällig.

5. Lieferung
Wir liefern innerhalb der Europäischen Union. Wir versenden:

  • Lagerware: ca. 3 Werktage nach Zahlungseingang
  • Produktion auf Bestellung: ca. 5 Werktage nach Zahlungseingang

Bei hohem Auftragsvolumen kann es zu längeren Versandzeiten kommen. Wir bitten um Verständnis – Happy Mary Studio ist ein kleines, unabhängiges Label.

Die Lieferzeit nach Versand hängt vom gewählten Versanddienstleister ab und liegt außerhalb unseres Einflussbereichs.

Versandkosten:

  • Sparversand (Deutsche Post Warensendung, ohne Trackingnummer): 2,70 EUR
  • Standardversand (DHL): 5,99 EUR
  • Kostenloser Versand ab einem Bestellwert von 55,00 EUR

Happy Mary Studio haftet nicht für Verluste oder Verzögerungen beim Sparversand, da keine Trackingnummer ausgestellt wird. Wir empfehlen bei wertvollen Bestellungen den Standardversand.

6. Widerrufsrecht & Rückgabe
Sie haben das Recht, Ihre Bestellung innerhalb von 14 Tagen nach Erhalt der Ware ohne Angabe von Gründen zu widerrufen.

Ausgenommen vom Widerrufsrecht sind:

  • Personalisierte und individuell angefertigte Produkte (Custom Orders)

Zur Ausübung des Widerrufsrechts senden Sie bitte eine E-Mail an hi@happymarystudio.de. Wir schicken Ihnen dann die Rücksendeadresse zu. Bitte verpacken Sie die Ware sorgfältig (idealerweise in der Originalverpackung) und frankieren Sie das Paket korrekt. Rücksendekosten trägt der Käufer. Wir stellen keine vorfrankierten Rücksendeetiketten zur Verfügung.

Nach Erhalt und Prüfung der Rücksendung erstatten wir den Kaufpreis innerhalb von 14 Tagen.

7. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte. Bitte beachten Sie, dass es sich um handgefertigte 3D-gedruckte Produkte handelt – kleine Unregelmäßigkeiten sind produktionsbedingt und kein Mangel.

8. Haftungsbeschränkung
Happy Mary Studio haftet nicht für Schäden, die durch unsachgemäße Verwendung der Produkte entstehen. Die Haftung für leichte Fahrlässigkeit ist ausgeschlossen, soweit keine wesentlichen Vertragspflichten verletzt werden.

9. Datenschutz
Informationen zur Verarbeitung Ihrer personenbezogenen Daten finden Sie in unserer Datenschutzerklärung auf happymarystudio.de.

10. Streitbeilegung
Die EU-Kommission stellt eine Plattform zur Online-Streitbeilegung bereit: https://ec.europa.eu/consumers/odr. Wir sind nicht verpflichtet und nicht bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

11. Anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland. Für Verbraucher innerhalb der EU gelten zusätzlich die zwingenden Verbraucherschutzvorschriften des jeweiligen EU-Mitgliedstaates.

Terms and Conditions
Happy Mary Studio – Maria Thaens

1. Scope
These Terms and Conditions apply to all orders placed through the online shop happymarystudio.de. The contracting party is Maria Thaens, Happy Mary Studio (hereinafter "Happy Mary Studio").

2. Conclusion of Contract
By submitting an order, you make a binding offer to purchase. The purchase contract is concluded once we confirm your order by email.

3. Prices & Taxes
All prices are stated in euros and include the applicable statutory VAT. The applicable VAT rate depends on the country of delivery within the EU.

4. Payment
Payment is made via the payment methods available in the shop (PayPal and all payment methods offered by Shopify Payments). Payment is due immediately upon completion of the order.

5. Delivery & Shipping
We deliver within the European Union. Our dispatch times are:

  • Items in stock: approx. 3 working days after receipt of payment
  • Made-to-order items: approx. 5 working days after receipt of payment

During periods of high demand, dispatch times may be longer. We appreciate your understanding – Happy Mary Studio is a small, independent label.

Delivery times after dispatch depend on the chosen shipping provider and are beyond our control.

Shipping costs:

  • Economy shipping (Deutsche Post, no tracking number): EUR 2.70
  • Standard shipping (DHL): EUR 5.99
  • Free shipping on orders over EUR 55.00

Happy Mary Studio cannot be held liable for loss or delays with economy shipping, as no tracking number is provided. We recommend standard shipping for higher-value orders.

6. Right of Withdrawal & Returns
You have the right to withdraw from your order within 14 days of receiving the goods, without giving any reason.

Excluded from the right of withdrawal:

  • Personalised and custom-made products (custom orders)

To exercise your right of withdrawal, please send an email to hi@happymarystudio.de. We will then provide you with the return address. Please pack the item carefully (ideally in the original packaging) and ensure the parcel is correctly labelled. Return shipping costs are borne by the buyer. We are unable to provide prepaid return labels.

Upon receipt and inspection of the return, we will refund the purchase price within 14 days.

7. Warranty
Statutory warranty rights apply. Please note that these are handmade 3D-printed products – minor irregularities are inherent to the production process and do not constitute a defect.

8. Limitation of Liability
Happy Mary Studio is not liable for damages resulting from improper use of the products. Liability for minor negligence is excluded, provided no essential contractual obligations are breached.

9. Data Protection
Information on the processing of your personal data can be found in our Privacy Policy at happymarystudio.de.

10. Dispute Resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Applicable Law
The law of the Federal Republic of Germany applies. For consumers within the EU, the mandatory consumer protection provisions of the respective EU member state also apply.
